Terms of Service
These terms are an agreement between you and SoCal (“SoCal”, “we”), operated from the United States, and they govern your use of the SoCal app and joinsocal.com (the “Service”). By creating an account or using the Service, you agree to them and to our Privacy Policy. If we make material changes, we’ll notify you in the app or on this site before they take effect; continuing to use SoCal after that means you accept the updated terms.
Who can use SoCal
You must be at least 13 years old. You may only create an account with your own phone number, you’re responsible for activity on your account, and you’ll keep the information on it accurate.
Your content
You own what you post: events, calendars, photos, and your profile. So that SoCal can work, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute that content, sublicensable to the infrastructure providers who run the Service, solely to operate, provide, and improve the Service. The license ends when you delete the content or your account, except for content you shared that others still legitimately hold (an event already on a friend’s calendar, a copy in a backup that ages out shortly, or an invite link preview you made public).
Community rules
SoCal is for making plans with people, and we have zero tolerance for objectionable content or abusive users. Don’t post or send anything that is illegal, threatening, harassing, hateful, pornographic, deceptive, infringing, or that you don’t have the right to share; don’t impersonate others, spam invites, harvest data, interfere with the Service, or try to access accounts or data that aren’t yours.
You can report any event or profile and block any user directly in the app, or reach us anytime at stan@sedberry.co. We act on objectionable-content reports within 24 hours, including removing the content and ejecting the user who provided it. We may remove any content or suspend or terminate any account that violates these terms.
Invites and contacts
Invites are sent at your initiative, one person at a time, and you are responsible for them: by inviting someone or matching your contacts, you confirm you have their consent to share their contact information with SoCal for that purpose. Standard carrier message rates may apply to sign-in texts.
Events happen in the real world
SoCal is a tool for organizing plans. We don’t host, run, endorse, or supervise the events created on it, and we aren’t a party to disputes between users or event-goers. Use your own judgment about what you attend and who you share plans with.
SoCal’s property
The Service itself (the app, site, design, and branding) belongs to SoCal and its licensors. We grant you a personal, non-transferable license to use the app on Apple devices you own or control, as permitted by the App Store Usage Rules. If you send us feedback, we may use it without obligation. If you believe content on SoCal infringes your copyright, email stan@sedberry.cowith the work, the location of the material, and your contact information, and we’ll act on valid notices.
Ending your account
You can stop using SoCal anytime and delete your account in the app (Settings → Delete Account), which removes your data as described in the Privacy Policy. We may suspend or terminate accounts that violate these terms or put the Service or its users at risk. We may also change or discontinue features of the Service; if we ever discontinue it entirely, we’ll give reasonable notice.
Disclaimers
SoCal is provided free of charge, “as is” and “as available,”without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don’t warrant that the Service will be uninterrupted, error-free, or that content will be preserved. Some jurisdictions don’t allow certain warranty exclusions, so parts of this may not apply to you.
Limitation of liability
To the maximum extent permitted by law, SoCal will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service, including anything that happens at events organized through it. Our total liability for all claims relating to the Service is limited to the greater of $100 or the amount you paid us in the past twelve months. Some jurisdictions don’t allow these limits, so they apply to the fullest extent permitted.
Apple App Store
The app is distributed through Apple’s App Store, so Apple requires us to tell you the following. These terms are between you and SoCal only, not with Apple, and SoCal, not Apple, is solely responsible for the app and its content. Apple has no obligation to provide maintenance or support for the app. If the app fails to conform to an applicable warranty, you may notify Apple and Apple will refund any purchase price (there is none; SoCal is free); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing claims by you or third parties relating to the app, including product liability, regulatory, consumer protection, or IP claims; those are ours. You represent that you are not located in a country subject to a U.S. government embargo or designated as terrorist-supporting, and are not on any U.S. government prohibited or restricted parties list. You must comply with applicable third-party terms when using the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Governing law & general
These terms are governed by the laws of the State of California, without regard to conflict-of-law rules, and disputes belong exclusively in the state or federal courts located in California, except that either of us may bring qualifying claims in small-claims court. If any provision of these terms is found unenforceable, the rest remain in effect. You may not assign these terms; we may assign them in connection with a merger, acquisition, or sale of the Service. These terms and the Privacy Policy are the entire agreement between you and SoCal about the Service.
